These Terms constitute a legally binding agreement between you and Intolerance.app ("Intolerance.app," "we," "us," or "our"). Please read them carefully.

2. Description of Service

Intolerance.app is a health and wellness application that helps users identify potential food intolerances by analyzing correlations between food consumption and symptoms. Our Service includes:

• Food and meal logging with ingredient tracking
• Symptom logging and severity tracking
• AI-powered analysis to identify potential food-symptom correlations
• Personalized recommendations and insights
• Data export and reporting features
• AI-powered features (with Analysis Pack purchase)

4. User Accounts and Registration

4.1 Account Creation

To use certain features of our Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

4.2 Age Requirements

You must be at least 13 years old (or 16 in the EU) to use our Service. If you are under 18, you must have parental or guardian consent. By using our Service, you represent and warrant that you meet these age requirements.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. You may terminate your account at any time through your account settings or by contacting us.

5. User Responsibilities and Conduct

You agree to use the Service only for lawful purposes. You agree NOT to:

• Use the Service in any way that violates applicable laws or regulations
• Impersonate or attempt to impersonate Intolerance.app, our employees, or other users
• Engage in any activity that interferes with or disrupts the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use automated systems (bots, scrapers) to access the Service without permission
• Upload or transmit viruses, malware, or other malicious code
• Collect or harvest personal information of other users
• Use the Service for any commercial purpose without our written consent
• Reverse engineer, decompile, or disassemble any part of the Service

6. Purchases and Payment Terms

6.1 Analysis Pack

Intolerance.app offers a one-time purchasable "Analysis Pack" that unlocks AI-powered features. Each pack includes a fixed number of credits (photo analysis credits, AI analysis credits, and PDF export credits). Packs are stackable — you may purchase additional packs at any time.

• Credits never expire and remain in your account until used
• Credits are non-transferable between accounts
• Manual food and symptom logging is always available without purchase

6.2 Payments

• All purchases are one-time payments — there are no recurring charges
• Payments are processed securely through Stripe
• Prices are displayed in your local currency via Stripe Adaptive Pricing
• You authorize us to charge your selected payment method for the purchase amount

6.3 Refunds

Refund requests may be submitted within 14 days of purchase if no credits have been consumed. Once credits have been used, the purchase is considered final. Refunds required by applicable consumer protection law (including EU right of withdrawal) are honored regardless of credit usage.

7. Intellectual Property Rights

7.1 Our Content

The Service and its original content, features, and functionality are owned by Intolerance.app and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Your Content

You retain ownership of any content you submit to the Service (meal logs, symptom reports, photos, etc.). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content solely for the purpose of providing and improving the Service.

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We comply with applicable data protection laws, including GDPR and CCPA. You have rights regarding your personal data as described in our Privacy Policy.

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Medical Warranty

WE DO NOT WARRANT THAT THE SERVICE WILL ACCURATELY IDENTIFY FOOD INTOLERANCES OR THAT THE INFORMATION PROVIDED IS COMPLETE, ACCURATE, OR RELIABLE. THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INTOLERANCE.APP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Intolerance.app and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms, your use or misuse of the Service, or your violation of any rights of another party.

11. Dispute Resolution

If you have a dispute with us, you agree to first contact us and attempt to resolve the dispute informally for at least 30 days before initiating any formal proceedings. EU and EEA users may have additional rights under local consumer protection laws.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and data (subject to legal retention requirements)
• You remain liable for any outstanding fees or obligations
• Provisions that by their nature should survive termination will survive

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page, updating the "Last Updated" date, sending you an email notification, and displaying an in-app notification. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

14. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and Intolerance.app regarding the Service and supersede all prior agreements and understandings.
